Another EAS Mess Could Blindside FOX Affiliates

On Sunday, prior to the start of its 1pm Eastern coverage of the National Football League, the FOX television network aired a 45-second promotional message that in its first three seconds incorporated an EAS tone.

The promotion ran nationally, on affiliates and on FOX-owned stations. While the FCC Enforcement Bureau’s Chief, Rosemary Harold, is likely reviewing the matter along with her team, non-FOX owned television stations that had no idea the promotional message was set to air until after the fact could also be held liable for what appears to be a blatant violation of Commission rules on emergency alert messages.

Or, are the affiliates not the guilty party, thus escaping a potentially large financial penalty?

Spears, Parenti Now LABF Board Members

WASHINGTON, D.C. — The President and Publisher of Streamline Publishing’s Radio Ink and Radio + Television Business Report and the VP of Licensing and Industry Relations at BMI have been elected to the Board of Directors of the Library of American Broadcasting Foundation (LABF).

Taking the seats, respectively, are Deborah Parenti and Dan Spears.

The announcement came from co-chairs Jack Goodman, former NAB general counsel and longtime DC-based communications attorney, and Heidi Raphael, Beasley Media Group Chief Communications Officer.  “The LABF Board, and the broadcast industry as a whole, is indebted to Ginny Morris for her service to the Library and its mission of preserving the legacy of broadcasting and archiving its history,” said co-chairs Heidi Raphael and Jack Goodman.

Goodman replaced Hubbard Radio chief executive officer Ginny Morris as co-chair of the LABF in mid-2021. Morris, who will remain on the LABF Board, had served as sole chair of the LABF Board of Directors for the past eight years.

The LABF also announced that board members Chandra Clark, Ginny Morris, Harry Jessell, Heather Birks, John Taylor, Joyce Tudryn, Larry Patrick, Richard Liebner, Michael Carter, Wally Podrazik and Dennis Wharton were elected to new three-year terms.

Executive Committee members elected to additional two-year terms were co-chair Heidi Raphael, Jim Morley, Joyce Tudryn, Marci Burdick, Harry Jessell and David Kennedy.

Kathleen Kirby, a partner at Wiley, has agreed to serve as LABF’s counsel.

The LABF serves the philanthropic arm of the Library of American Broadcasting, a collection of broadcast history, policy and tradition, including historical documents, professional papers, oral and video histories, books, scripts and photographs preserved at the University of Maryland in College Park, a suburb of Washington. In addition, the LABF, in conjunction with the International Radio & Television Society (IRTS), presents the Annual Giants of Broadcasting Event, which pays tribute to trailblazers in the radio and television industry.

A Fine Sunday For FOX? ‘Emergency Alert’ Raises EAS Alarms

In August, the Entertainment Sports Programming Network known as ESPN received a proposed fine from the FCC in the amount of $20,000 for its use of an emergency alert system (EAS) code during a documentary it aired in October 2020 as part of its popular 30 for 30 series.

It now appears FOX Television Stations, and perhaps all of its affiliates, may be liable for a similar violation — one tied to a somewhat mysterious “NFL EMERGENCY ALERT” supporting the Philadelphia Eagles pro football club.

On ‘Giving Tuesday’, Consider The Broadcasters Foundation

Giving Tuesday, the international day of giving, is November 30. The Broadcasters Foundation of America is asking for donations to help radio and television colleagues who are in acute need due to illness, accident, or disaster.

“There’s never been a better opportunity to make an impact by giving back and helping those in our business who have been hit by tragic and unthinkable circumstances,” said Tim McCarthy, Co-President of the Broadcasters Foundation. Scott Herman, Chairman of the Broadcasters Foundation, added, “As you’re thinking of the organizations you love and support, please consider including the Broadcasters Foundation in your donations.”

For over seventy years, the Broadcasters Foundation has provided medical aid and disaster relief to broadcasters and their families across the United States. This year, the Broadcasters Foundation will award more than $1.8 million in monthly and emergency grants.

Individual donations can be made to the Guardian Fund, corporate contributions are accepted through the Angel Initiative, and bequests can be arranged through the Legacy Society.

NAB To Congress: Sohn’s Locast Role Of Deep Concern

Until now, the fiercest vocal opposition to President Biden’s choice for a Democratic seat on the FCC has come from Republican Senate leaders such as Lindsey Graham.

That may still be the case. Yet, broadcast media’s biggest voice Inside the Beltway has “serious concerns” about Gigi Sohn. While her nomination is not being opposed by the NAB, it is very disturbed by her involvement in a now-shuttered service that purported to be a non-profit local TV-by-IP service that skirted around retransmission consent accords.

A Legendary Radio Figure In Canada, U.S., Loses Alzheimer’s Battle

For a generation of radio listeners, thanks to the programming influence of Bill Drake and a woman described by the Detroit Free Press as a “golden-eared tastemaker,” CKLW — “The Big 8” — became the dominant Midwest and Central Ontario Top 40 station of its day.

From taking a part-time job as a weekend switchboard operator to her rise in 1967 to Music Director, there’s perhaps been no person more influential to popular music and its dissemination via broadcast media than Rosalie Tromblay.

Now, former listeners of The Big 8 and radio industry veterans from across North America are pausing to pay tribute to Tromblay, who has died of complications from Alzheimer’s Disease at the age of 82.

Audacy Shares Dip To New 2021 Low

Just days after President/CEO David Field snapped up more shares of his company’s stock, Audacy Inc. stock on Wednesday continued its month-long downturn.

As the clock struck 1pm Eastern, AUD was down to a price last seen in late December 2020.

The price: $2.7250, reflecting a 4.4% dip from Tuesday’s trading.

If the closing price holds at this level, it would solidify a complete erasure of all 2021 share growth for the audio content and distribution company.

The latest dip sees Audacy Inc. shares fall by $1 per share since November 5, with AUD closing on that date at $3.75 per share.

Audacy’s market cap at 1pm was $385.5 million, and analysts maintain a $4.10 per share target price for AUD.

It was July 5 when Audacy stock was last at or near that price.

FCC to Host Video Programming Accessibility Forum

WASHINGTON, D.C. — The Media Bureau, together with the FCC’s Consumer and Governmental Affairs Bureau, will co-host a forum on December 2 to explore the state of closed captioning availability for online video programming.

The event will also see participants discuss ways to enhance accessibility, including the Commission’s authority to adopt new rules.

Furthermore, the Forum will explore current and prospective best practices and other existing or possible voluntary efforts that could enhance the availability of closed captioning online.

FCC Chairwoman Jessica Rosenworcel is scheduled to welcome Forum participants, while Senator Ed Markey (D-Mass.) will deliver keynote remarks.

The Forum will include two panels that will feature speakers such as television, cable, and online video programming distributors, academics and consumer advocates.

A Testy Wednesday On Tap For Sohn, Davidson

WASHINGTON, D.C. — With the nomination of Jessica Rosenworcel to formally take the Chair of the FCC unchallenged, the Senate Committee on Commerce, Science, and Transportation is expected to move forward with setting up a full Senate vote on President Biden’s pick to succeed Ajit Pai in a Committee markup session scheduled for Wednesday, December 1.

Once that markup concludes, get ready for some fireworks: Contentious FCC Commissioner nominee Gigi Sohn and National Telecommunications and Information Administration (NTIA) Assistant Secretary for Communications and Information nominee Alan Davidson will be teed up for consideration.

Their nominations are be among the most politically polarized and heavily scrutinized in ages.

Cox Explains To FCC Why It Won’t Sell WPYO To SBS

WASHINGTON, D.C. — As promised on November 19 by noted Houlihan Lokey media broker Elliot Evers, administrator of the “CXR Radio Station Trust, lawyers representing Apollo Global Management-controlled Cox Media Group and the trust have filed its Reply Comments in what’s officially “Media Bureau Docket No. 19-98” in “a timely fashion.”

To little surprise, the stance that CMG, and Evers, are taking is largely defensive, expressing the belief that poor economic conditions present an opportunity with precedent for the Commission to extend a divestiture deadline tied to Apollo’s majority ownership acquisition of Cox Media Group.

Audacy, iHeart, Emmis, SiriusXM Sued Over Syndie Show Content

LOS ANGELES — Every Saturday at 10am, listeners to iHeartMedia-owned conservative Talker KEIB-AM 1150 “The Patriot” can gain a greater sense of investment opportunities in the energy sector by tuning to “The Smart Oil & Gas Radio Show.”

The program has also been heard on iHeart’s KTRH-AM 740 in Houston, on radio stations owned by iHeartMedia, Emmis Communications, and on SiriusXM Satellite Radio. The central figure behind the show happens to be barred by FINRA, the Financial Industry Regulatory Authority, from acting as a broker or otherwise associating with a broker-dealer firm.

This explains why a group of plaintiffs have sued the four audio media companies in a Dallas Federal District Court, arguing that they should be held liable, in some way, for airing programming tied to “a known fraud recidivist.”

Forecast 2022: Sasso’s Thankful Return To An In-Person Conference

The last time Colorado Broadcasters Association President/CEO Justin Sasso attended an in-person broadcast conference was in February 2020. Travel back home to Denver was hectic, but with a cash reward for ample flexibility. Sasso’s next event wouldn’t be until one week ago, as he participated at Forecast 2022. Here’s what Sasso had to say about the February 16 gathering in New York, compared to his last non-virtual affair.

February 2020. Washington, D.C. I had a late-afternoon flight out of Reagan Washington National and was cajoled by a gate agent to give up my seat on an overbooked flight to Denver. Instead, I was to take a connecting flight through Houston. There would be a short layover, and I would be home an hour later than my original flight. The incentive was an $800 flight voucher to anywhere my heart desired.

Fifteen minutes later, I was paged back up to the gate agent’s desk, where I learned that my connecting flight from Houston to Denver was cancelled. My original flight home was long gone from the jet wing. However, the agent, wrapping up what seemed to be an intense call of airline agent jargon, slammed down his phone and informed me that one final option existed. It was a direct flight to Denver, leaving in 45 minutes. All I had to do was get from Reagan to Dulles International at 4:30 on a Wednesday afternoon. With the speed of an auctioneer, I negotiated an additional $300 flight voucher, cab fees and meal tickets, snapped them from the gate agent’s hand and bolted for the taxi stand.

Did I make it? That comes later, but first I want to tell you about my first broadcast conference since that hectic day in February of 2020: Forecast 2022, a lengthy twenty-one months later. Instead of slowly putting my big toe back into the pool of conferences, I went to the one nestled in mid-Manhattan, “The Big Apple,” “The City That Never Sleeps,” but does require proof of vaccination. Five weeks earlier, when [Fletcher Heald & Hildreth attorney] Frank Montero called me and asked me to participate in his panel, I had come to two conclusions. One, I was never going to fit in any of my suits again, as I had “gained the COVID-19,” and two, conferences were a thing of the past. The weight I could lose, but having witnessed the postponement of two NAB Shows made it seem that broadcasters might never gather in-person again.

This was my first invite to Forecast and I was excitedly anxious to attend. After all, this is the legendary gathering of industry giants, envisioning the future of our industry. In reality, it’s a manageable gathering of people who love our industry and want to keep it healthy and strong.

There were great takeaways during the back-to-back panels, featuring many of our industry’s best and brightest. Several panels made it clear that broadcasters need to continue embracing digital and use it for growth and outreach. Broadcasting and digital both provide platforms for unlimited creativity and when combined, the outcome can be advantageous for both the audience and the broadcaster.

First and foremost, as an advocate for broadcasters, I was delighted to hear the detailed blueprint laid out by FCC Commissioner Nathan Simington. The Commissioner cherishes the service broadcasters provide to their communities. It was clear that broadcasters have a friend at the Commission and an ally for any battles ahead. During the panel I participated on, I was given the opportunity to share my experiences with the soon-to-be-confirmed Chair of the FCC, Jessica Rosenworcel. In short, I think she will be fair to broadcasters, providing us with the opportunity to make our case on almost every broadcast decision that comes before the commission.

Aside from the abundance of data points, developing technologies, and thoughtful panel discussion, Senator Gordon Smith’s Lifetime Leadership Award acceptance speech was a significant highlight for me. The Senator never misses an opportunity to share a timely story that gently blends into a meaningful lesson. Using an account of a trip he took to Sao Paulo, Smith expressed the joy he received from supporting an industry that always places its community before itself. His speech concluded with a heartfelt standing ovation.

Thank you Frank Montero and Deborah Parenti for the opportunity to attend Forecast 2022 and jump back into the conference waters with both feet. I can declare that this is a conference not to be missed and I sincerely hope to participate next year.

By the way, I made that flight out of Dulles, panting slightly as I took my seat, but with $1,100 tucked in my wallet and relieved that I was heading home. I felt a similar relief as the wheels of the airplane left LaGuardia’s runway. I was leaving with a head full of knowledge, a swarm of new ideas and the feeling that everything is going to be okay.

The InFOCUS Podcast: Clark Smidt and WATX

WATX-AM 1220 is hardly a legendary radio station. Serving New Haven, Conn., and its surrounding communities, the Class B with 1kw of daytime power was all but left for dead by Quinnipiac University in May 2019. Some 17 months later, a veteran New England radio programming figure stepped in and rescued WATX — a facility he worked at in 1967 under its original WDEE calls.

Today, Clark Smidt is selling spots, playing the hits of yesteryear and just launched a direct mail campaign to 7 “hot ZIPs” within the WATX listening area. Is it a hobby, or an incubator designed to demonstrate why a licensee should never give up, and avoid turning in the license of a forlorn AM property?

Washington Mourns TV Meteorologist Doug Hill

For a generation of local TV news viewers across the National Capital Region, Doug Hill was a household name — a trusted source of local weather reports and a friendly face to those tuned to WJLA-7, the ABC station once owned by the Allbritton family that’s been owned by Sinclair Broadcast Group since 2014.

Now, thousands of viewers, as well as media industry figures across Washington, are stopping to remember Hill, who has died.
