REC EZforms Ordering Process, Fees, Terms and Conditions.

About EZforms

  • Using EZforms, you will answer a series of questions in plain English with either Yes/No answers or be prompted to enter in information.
  • Once you finish the form, the information will be transmitted to REC and an order is created in our ordering system.
  • REC will review the validity of the information and verify the FRN password submitted.
  • REC will then send you an email that will confirmed that we received your order.
  • For certain order types (such as assignment of license, transfer of control, etc.), we will send you an email to continue the process to get more information.
  • In any case where we have questions, we will send an email. 
  • If everything looks good, you will receive an email from PayPal with an invoice.
  • Only pay the invoice if you wish to proceed with REC doing your FCC application.
  • Once payment is received, the application is filed with the FCC.
  • You will receive an email from REC confirming that the application has been filed with the FCC and it will include the FCC's file number for that application.
  • Except for license renewals, when the application is granted, you will receive an email from the FCC with your authorization.  Renewal authorizations can be retrieved from REC's FCCdata.org after grant.

Fees

  • Fees are based on a "level of effort" as opposed to an hourly rate.
  • Prices quoted on the EZforms interface are estimates only.  Actual prices will be quoted either through email or via the invoice.
  • REC requires pre-payment of fees prior to any FCC application filing and/or the release of any exhibits prepared by REC.
  • Even though we use PayPal for billing, you do not need to have a PayPal account, only a major credit or debit card.
  • Invoices only need to be paid if you wish to receive services.  If you do not want REC to handle the application, do not pay the invoice.
  • Payment by check is also available, but will delay your filing.  Please contact REC for more details.
  • Money orders are never accepted as payment.
  • For commercial stations, the FCC also imposes filing fees based on the order type.  When a commercial order is placed, you have one of two ways of paying the FCC:
    • REC can take a credit card number of the phone solely for the purpose of paying FCC fees.  This requires a two way communication with us.  Never leave your credit card number on voice mail and definitely do not send your credit card information by email.
    • You also have the option of accessing the FCC's Fee Filer after the application is filed to pay the fee.  It is important to remember that if you choose to use this method, the application will not be processed by the FCC until the fee is paid.  In addition, the FCC may dismiss an application if the fee is not made within a certain time.  In these situations, REC will provide no refunds for our fees and if the application needs to be refiled, we would be able to do it for a minimal "level of effort" based fee.
    • REC can not bill you for the FCC filing fees on the invoice.
  • Tips: PayPal has a method of adding a "tip" to an invoice payment.  These tips are considered donations and are never refunded, even if the situation is extraordinary and would warrant a refund (such as an error caused by REC). 

Terms and Conditions

  • FCC application work under the names "REC" or "REC Networks" is handled by Michelle Bradley, CBT, as a private individual.
  • REC has a no refund policy, therefore, applications requested through EZforms are nonrefundable.  By using our services, you waive REC Networks and Michelle Bradley of any liability or consequential damages encountered as a result of using REC services.
  • In the event of an error made by REC, a refund may be granted at our discretion, based on the situation (such as whether the error can be fixed and still result in a potentially grantable application).  As mentioned, any "tips" that are made over and above REC's quoted invoice price are considered donations and are not normally refunded.  Our liability is limited only to fees paid to REC specifically for the service and does not include tips, FCC fees or any anciliary expenses incurred by the applicant. 
  • Applicants are responsible for assuring that the information entered on the EZform and given to us on subsequent communications is accurate.  If you notice you made an error, after you submitted the EZform, but before you paid the invoice, please let us know.  We are very flexible where it comes to that. 
  • REC is not responsible for the outcome of your application with the FCC.  Going with REC does not guarantee a grant, especially during filing windows.  If there is an issue on your application, we may be able to work with you on the situation.  Depending on the change needed, a fee, based on "level of effort" is charged.
  • The applicant is responsbile for knowing all FCC rules and policies.
  • Michelle Bradley is not an attorney and does not claim to be one.  Any information given from REC through emails, phone calls, social media, text messaging or on the REC websites should never be construed as legal advice.  For legal advice, please contact a qualified attorney.
  • Waivers are at the discretion of the FCC.  REC does not provide refunds for denied waivers.  If a waiver is denied, REC can refile at a location/channel that would not require a waiver.  Additional "level of effort" fees may be payable for those services.
  • Any kind of services related to pleadings such as informal objections and petitions to deny, or any responsive pleading as well as appeals through petitions for reconsideration, applications for reviews and court filings are not handled by REC.  In the event of an informal objection or petition to deny against the application, it would be best to provide the services of a qualified attorney.  REC can answer basic questions but we do not give legal advice.  If you do not have an attorney, we can refer you to one.   REC is not responsible for applications that are dismissed as a result of an informal objection or petition to deny. 

Certain situations

  • Silent stations: Broadcast stations that fail to broadcast signals for at least 365 consecutive days will be cancelled by matter of law pursuant to Section 312(g) of the Communications Act.  Special temporary authority (STA) applications for silent stations are normally granted for a six month period.  It is important that if you need it extended, to contact us for that extension. There may be a minimum "level of effort" fee imposed.  It is important to remember that if you have an extension on a silent STA, the one year silence period (Section 312(g)) will always prevail no matter the expiration date of the STA. When the station resumes operation, please notify REC as soon as it is up and running.  If you already paid for REC to handle your silent station request, we will handle the resumption of operations notice at no additional fee.
  • Assignment of license: REC Networks does not have attorneys and therefore is unable to construct and help execute an Asset Purchase Agreement (APA).  Only an attorney can construct contracts.  If you and the assignee reach an APA, then you must include the APA to REC upon request to be included with the filing.  LPFMs and unbuilt construction permits have specific limits on what consideration a party can accept for a license or permit.  Please contact REC for details.
  • Construction permits: Applications filed which involve a construction permit normally lasts for 36 months.  With the exception of certain natural and other events, the FCC will not normally extend that period.  It is the applicant's responsibility to assure that their facility is built on time.  REC will not refund for expired construction permits.  If an expired construction permit needs to be filed and is able to be filed, REC will re-file it.  "Level of effort" fees will vary based on what changes may need to be done to the original exhibits.

Privacy Policy

  • REC utilizes IP tracking as well as general logging to insure the integrity of our network and to identify issues with our sites and application.  This IP tracking normally does not carry any specific identifying information on an individual.  IP addresses can be cross-referenced with ARIN to determine the owner of a specific IP address.  While normally this is an ISP or a company, indivuduals that have IP addresses registered with ARIN would be able to be identified by IP address.  An extremely large majority of internet users do not fall under this category. 
  • REC stores applicant information in a database.  While REC does carry a lot of public data from the FCC, other administrations as well as data created by REC, application data from EZforms is stored in our separate Work Flow System (WFS) that is not visible to the general public.
  • Various REC applications, such as those used for our broadcasting databases may collect and store information regarding the specific transaction including the nature of the request.  This information may be used by REC to gauge the demand for broadcast services, but we do not disclose any details of any specific transaction.  
  • The REC EZforms system is not intended for children under the age of 13, pursuant to the Children's Online Privacy Protection Act (COPPA).
  • REC may use third-party applications such as StatCounter to track and analyze site usage. 
  • REC may utilize some third-party providers for mapping, fundraising and other services.  Users should consult the privacy policy for the respective third-party service for more information on their policies.
