REC LPFM Advisory Letter #13 - NCE Filing Window Impact to LPFM Stations on Channels 201~222 (88.1~92.3) - Encroachment and Potential Displacement

This revision is a routine update to this Advisory Letter to reflect actions taken by the Media Bureau and the full Commission in the 2021 NCE Window as well as subsequent modifications filed by NCE grantees.  

Introduction

Low Power FM (LPFM) is a secondary service.  This means that in the event that spectrum is needed by a primary full-service station, the LPFM station has no rights of protection and depending on the spectrum need, must either discontinue their currently authorized facility or may be subject to increased incoming interference.  The secondary status of the LPFM service is mandated by law in Section 5(3) of the Local Community Radio Act of 2010. 

The FCC held a filing window for new full-service noncommercial educational (NCE) FM broadcast stations from November 2 through November 9, 2021.  This filing window was for the 20 reserved band channels from 88.1 through 91.9 MHz.  REC originally advised LPFM stations of this window on April 22, 2021 in LPFM Advisory Letter #2.

This Advisory Letter includes a computer generated report that is enhanced by manual check of each LPFM station that was predicted to encounter some form of encroachment. 

Displacement of LPFM Stations

Section 73.809 of the FCC Rules specifies the definition of interference and the specific handling of existing LPFM stations in the event of full-service station application activity.  

Action-eligible interference takes place when the appropriate interfering contour of the LPFM station reaches a certain point in respect to the full-service station.  In respect to proposed full-service facilities, it is considered when the LPFM interfering contour (40 dBu for co-channel and 54 dBu for first adjacent channel) overlaps anywhere within the following:

  • The 70 dBu protected contour (this is also known as the "city grade" contour in commercial radio).
  • The community of license of the full-service station.  
  • Any area of the community of license of such full service station that is predicted to receive at least a 60 dBu signal.

Unlike commercial stations which must include a significant portion of the community of license within the 70 dBu city grade contour, NCE FM stations operating on the reserved band channels (88.1~91.9) are only required to place a 60 dBu contour over at least 50% of the designated community of license. 

LPFMs on second-adjacent channels of proposed NCE stations are not subject to displacement under §73.809.  See more information about second adjacent channel stations below.

It is important to remember that §73.809 displacement is not automatic. In other words, the FCC will not, by default, send you a shut-down letter once the full-service station's application is granted or even afer they go on the air.  Instead, the complaint process must be initiated by the full-service station's license holder.  Full-service stations must send a copy of the complaint to both the FCC and the LPFM station.  If an LPFM station gets a complaint (served by the full-service station), they must discontinue operations within 24 hours.   An LPFM may only resume operations when directed to by the FCC.  In the event of a §73.809 shutdown, the LPFM is to follow up with a report to the FCC regarding the interference. 

List of Potentially Displaced LPFM Stations

REC is issuing advisories to the following LPFM stations to advise they should watch the progress of the applications filed in the NCE Filing Window and be prepared to take remedial action to change operations to a different channel as a result of a potential complaint by a new full-service station or highly intolerable incoming interference:

  • KWRK-LP Fairbanks, AK
  • KCWG-LP Crown King, AZ (granted CP to change channels)
  • KXWR-LP Tsaile, AZ
  • WKMP-LP Eastman, GA
  • KAKU-LP Kahului, HI
  • KPCY-LP Lake Providence, LA
  • KEQQ-LP Grand Forks, ND
  • KTHN-LP Texarkana, TX
  • WYTC-LP Hyde Park, VT
  • KXPB-LP Pacific Beach, WA
  • KLZL-LP Ten Sleep, WY

The following stations have already taken action to request modification of facilities based on the 2021 NCE Filing Window:

  • KQLO-LP Clarksville, AR

Reserved Band LPFM Stations Upgrading

Several LPFM stations have participated in the NCE Filing Window to upgrade or "graduate" their facilities to full-service.  In most cases, reserved band LPFMs proposed their own channels.  While we are happy to announce that many of these applicants may win their MX groups, our raw report below shows machine and human generated comments in the event that an unexpected twist takes place and another applicant wins (e.g. the LPFM's NCE application being dismissed).  The following LPFM stations within the scope of this report have filed to upgrade in this window:

  • KAWD-LP Detroit Lakes, MN (NCE application granted)
  • KEQQ-LP Grand Forks, ND (Not lead applicant, subject to §73.809 displcement)
  • KYEJ-LP Fairmont, MN (NCE applciation granted)
  • WFGU-LP Winchester, OH (NCE application granted)
  • WMPF-LP Rumford, ME (NCE application granted)

Encroachment Warnings

§73.807(a) of the Rules includes two different distance values for each class and channel relationship (co-channel, first-adjacent, etc.).  The lower value is a minimum distance required in order for an LPFM station to be placed.  The second value, which may be the same or higher than the minimum distance, is a "recommended" distance for where an LPFM station is not expected to receive any incoming interfrence (in other words, the distance where, based on full facilities and flat earth, a full-service station's interfering contour does not overlap the LPFM service contour).

Absent the §73.809 style of contour overlap we have already mentioned, LPFM stations may operate from inside the interfering contours of full-service stations and many do.  With that, the LPFM station must accept any incoming interference from those full service stations and they have no grounds to complain about a full-service station operating with their authorized facilities.

When the spacing between the LPFM and the proposed full-service facility does not meet that second "full-spaced" value in §73.807(a), it will trigger an "encroachment warning" at REC.  The following LPFMs are not subject to §73.809 displacement but we have issued new encroachment warnings as a result of the outcome of the window:

  • KVAN-LP Tucson, AZ
  • WGGM-LP Fort Myers, FL
  • KOPO-LP Paia, HI (unlikely due to intervening terrain)
  • KCIU-LP Lawrence, KS 
  • WDSW-LP Cleveland, MS
  • KPIM-LP Broken Arrow, OK (pending CP to change channels)
  • KOKT-LP Tulsa, OK (pending CP to change channels)
  • KVBE-LP Portland, OR
  • WQWA-LP Columbus, WI

These stations should closely monitor the activity of the NCE Window aftermath and be aware that once the impacting NCE stations come on the air, it may or may not cause incoming interference to the LPFM stations.  LPFMs should contact their engineering counsel, consultant or REC for further examination of their situation and next steps.

Mutually Exclusive Groups of Applications

There were over 1,200 applications filed in the NCE Window.  Of those, about two thirds of them are in one of over 200 groups of competing or "mutually exclusive" applications.  Those groups will be resolved first through a priority system based on an interpretation of the Fair Distribution law (47 USC §307(b)) and then through a point system.  More information on full-service NCE stations including the priority and point system can be found at this URL:

REC Networks has conducted a computer based study on all LPFM stations currently authorized to operate on 88.1 through 92.3 (Channels 201~222) to determine if any of the full-service NCE applications filed during the window meet the §73.807 distance separation requirements and recommendation for no interference received and if they did not, they would show on the report. 

Lines beginning with a dash (-) were generated by the computer program.
Lines beginning with an asterisk (*) were generated by a human.

You may see references to "garbage list" applications.  Those are applications, that during REC's evaluation of all NCE window applications filed, would likely be ungrantable due to major technical or other shortcomings.  Thus, we expect "garbage list" applications to be dismissed.
