This list contains projected outcomes for all remaining groups.  These outcomes are subject to change based on the outcomes of any petitions to deny and informal objections filed, the acceptance of any applicant  at the time of final study (such as the check of their consistent corporate status) as well as the outcome of any petitions for reconsideration.  

The following abbreviations are used: P4R=Petition for Reconsideration, IO=Informal Objection, PTD=Petition to Deny, non-T/S=Non-tentative selectee. Also, we are including IOs that were filed prior to the MX window. FCC rules permit IOs to be filed at any time (this is different than PTDs) but they will not be entertained until after the application is accepted for filing.  These pre-window filings will be shown in italics.

Granted applicants with a red asterisk * are subject to either the main studio pledge, the local programming pledge or both based on their application and subsequent FCC determination of points..

Greater Birmingham changes to 94.1 at their current location.  Calvary and Greater clash on their new channel. (12/29) FCC denies amendments for Calvary and Greater BHM. (12/29) Calvary moves south and changes to 94.1 to become singleton. (12/29) Love Commandment and Church in Birmingham reach time share agreement. (1/21) Kimtron Inc., licensee of second adjacent WDJC files PTD against Church in Birmingham, Greater Birmingham Ministries, Love Commandment Ministries and Calvary of Birmingham claiming that these second adjacent channel stations will interfere with WDJC's IBOC subcarriers.  (1/23) Greater Birmingham moves 3.6 km to clear itself of Calvary of Birmingham. (1/29) PTD against Calvary denied. FCC states that protection of the analog signal also protects the digital signal and that stations running with IBOC hybrid subcarriers are not entitled to any additional protections.  Kimtron's PTD against Love Commandment also addresses issues with local presence. (1/30) FCC grants the Love Commandment and Church in Birmingham time share for the same reasons it denied Kimtron and in the case of Love Commandment, since there were only two MX applicants remaining, the timeshare agreement is a universal settlement and point aggregation was not involved making Kimtron's challenge moot. (3/6) Kimtron files P4R on grants of Church in Birmingham and Love Commandment stating in part that the decision to deny their original IO by public notice violates 309(d)(2) as no rules were cited and no details were given. [Ed:] REC agrees with this part of the finding.  The FCC should have communicated the dismissal of the IO through letter and not through public notice.  We still disagree with Kimtron's findings about how hybrid IBOC stations should be afforded additional protection beyond their current analog bandwidth.  (12/22) FCC denies Kimtron's P4R.  Dismisses Greater Birmingham Ministries due to application not being signed by an officer. (1/21/16) Kimtron files AFR on Church, Calvary and Love Commandment requesting full Commission review of Audio's decision that LPFM protection requirements are for the analog signal only and no additional protections are given if the full power station is operating hybrid digitial. Because the FCC determined that Cocoa Minority "failed to disclose the parties to the application as required by FCC Form 318", they deny the P4R. (3/13) Blessed Assurance files a "Plaintiff's Petition to Deny Defendant's Request to Reconsider" moves for the FCC to "uphold" the dismissal. [Ed:] This filing is totally unnecessary and out of order.   The P4R was dismissed the day before this was filed. The case is closed unless Cocoa Minority files an Application for Review.  Also, Blessed's statements regarding foreign corporations are misguided.  The FCC has already upheld that foreign corporation status is irrelevant for NCE purposes.  The FCC only requires that the organization is recognized by a state as a corporation. (3/20) Wade Gordon files IO against East Coast alleging pirate operations.  (3/23) Wade Gordon supplements his IO detailing a personal dispute. (3/23) Coca files AFR. (3/30) East Coast files an opposition to Wade's IOs. While not specifically stating it, East Coast suggests that the transmitter operating was a Part 15 device where it covered (as he put it) "30 to 50 feet". The opposition also covered other issues too. (4/10) FCC denies IOs filed stating that the information about the alleged pirate operation is hersay as there has been no enforcement actions.  Part 15 operations do not justify denying an LPFM license.  No evidence that East Coast violated the rules.  Rockledge and East Coast will now go into involuntary time share. 30 day letter starts today. Tampa Radio also files IO against International Religion and Cultural Exchange claiming they were not a valid organization at the time of filing.

Youth Broadcasting in Radio files IO against Sulfur Springs (as well as BJR Cmty. R in group 91, Azalea Park Cmty R. in group 91, Lake Mary Cmty R. in group 91, Hunters Creek Education Radio in group 115 and Alafaya Cmty R. in group 116) claiming attributable interests with WRLZ-FM.  Sulfur Springs replies that Jorge Baez (who is with WRLZ) is just a language bridge and is not a party to the application. (1/2014) YBR files another IO continuing to claiming a conflict of attribution and raising foreign corporation issues (those corporations registered in different states).  Sulfur Springs replies that YBR's claims are frivilous and there are no rules against foreign corporations. YBR files another IO raising the foreign corporation issue. 

Paula Perez files IO against Sulfur Springs claiming that the applicant was manufactured by Leo Ashcraft and then goes further into a personal attack against Leo. 

Tabernacle of Zion changes to 106.9. There is also a 12/29 application filed for translator W293CK that is MX.  Since the LPFM was amended on 12/24 and the translator was filed after business hours (hence the "1229" application number), we believe the LPFM will prevail.  Latino Heritage Organization moves northwest and changes to 105.1 and becomes singleton. (2/3) The FCC denied a P4R that was filed by US Pro Descubierta due to a change of more than 50% to the board of directors. US Pro was dismissed prior to the December, 2014 public notice and therefore was not an identified applicant. (3/8) Sulfur Springs changes to 101.9 to become singleton. (3/10) FCC dismisses International Religion and Cultural Exchange due to the organization being dissolved in 2002 and not reinstating prior to the window.  The FCC found Latino Heritage Organization to be qualified to be a licensee.  The IO filed by Tampa Radio Group was not strong enough to show who the alleged party had an attributable interest at another LPFM station. In addition, the fact that the organization became incorporated 9 days before the window was not an issue as those points were not claimed (TRG's impression was that LPFM applicants were required to have 2 years local presence regardless.) (4/29) US Pro makes another frivilous filing against Tabernacle and Sulfur Springs to attack Leo Ashcraft and REC.  (5/4) REC motions to intervene into the proceeding to address accusations made by US Pro and to state that US Pro has committed a prohibited ex parte presentation by incluidng a copy of REC's "Applications of Concern" list with their filing. (5/11) US Pro files reply. (1/28/16) Sulfur Springs Community Radio voluntarily dismisses. (2/16/16) Tabernacle of Zion dismissed for failure to disclose parties and a non-party signatory. There are rules that state that any changes in the schedule for the time share agreement must be agreed upon by all parties.  It should just reduce the points.  The two groups still make a 10 point group which beats Altamonte.  The current arrangement will eventually result in Awakening and Ministerio RM to both have unlimited hours due to spacing.  This means that out of the 12 applicants in the "East Coast MegaGroup", 11 of them will likely be on the air at the same time. (4/27) Haitian Relief has had a case of "applicant's remorse" and is requesting to be placed back on their original frequency of 99.9 as a part of their original time share agreement prior to the 3/23/15 change to 91.9. (4/29) US Pro makes another frivilous filing against Azalea Park to attack Leo Ashcraft and REC.  (5/4) REC motions to intervene into the proceeding to address accusations made by US Pro and to state that US Pro has committed a prohibited ex parte presentation by incluidng a copy of REC's "Applications of Concern" list with their filing. (3/18) Beware moves to the southwest and changes to 103.1.  (3/23) Beware moves to a different location stated it is contingent on WDKK-LP filing to vacate from 103.1.  WDKK-LP is asking for a site move of 6.42 km stating that the Commission "rounds" 5.6 km to 6km and therefore, 6.42 km rounds to 6km. In our past experience, we have not found this to be correct. A waiver was specifically not requested.  This will be a good test of the rules.  We do note that the WDKK move is also connected to South Florida FM in Group 109.  

This will either be a two or three party involuntary time share based on the outcome of the IO against 1Miami.

The AER application increased the power from 54 to 215 watts The LPFM application was never admended therefore, the facilities proposed by the LPFM were from before the translator making their change.  At 54 watts, the translator had a 7.278 km contour thus making it a lower tier only requiring 8 km of spacing.  At 215 watts, the translator goes to a 13.808 km contour putting them in the upper tier  requring 21 km of spacing.  The LPFM is 13.2 km from the translator.  In this case, the FCC improperly dismissed the LPFM as the LPFM was there first.  This is also an issue that stems from the fact that translators are not required to protect LPFMs on second adjacent but LPFMs must protect translators.  REC highly recommends that this applicant files a Petition for Reconsideration.  They can contact 1-844-REC-LPFM for assistance.

We have not experienced one of these yet (even though we have at least two in the Bay Area that are sunk in objections), we will have to see how this goes.

(3/26) The FCC declared that all four applicants were tied with 10 points each.  First, they dismissed the fourth place applicant based on community presence (North Austin Community Media).  Then on the other three applicants, they looked at the scores reflective of the dismissal of North Austin. As a result, Worker's Defense Project was also dismissed.   (4/22) North Austin files P4R and performs move to the south west.  While their new location is short spaced to Camino Del Rey's current location, Camino did file a mod to co-locate with time share partner Austin Cathedral. North Austin's move is over 5.6 km however is less than 6.49 km.  Austin is requesting a waiver of 73.870(a) citing a similar move for WROJ-LP that was granted. In their argument, 5.6 rounds to 6 so therefore anything that rounds to 6 km is considered minor since 5.6 rounds to 6.  (5/7) North Austin P4R granted, application reinstated.
